In the case of Latif v. Holder the American Civil Liberties Union are representing 13 Americans who are currently blacklisted from flying. U.S. District Court Judge Anna Brown stated that placement on the No-Fly list equated to the revocation of a passport in the sense that both actions “severely burden the right to international travel”. The judge also stated that placement on the list smears citizens as suspected terrorists and violates their constitutionally protected right to be free of reputational harm. Judge Brown also requested further information on the process of being removed from the list before she rules on whether the policy violates the fifth amendment.
